Faulty decks , weatherproofing, doors, stucco and roof lead to 1.5 Million Settlement

Saw this press release from the Miller Law firm on a condo in San Francisco that recovered money for faulty construction...

/PRNewswire/ -- A contemporary condominium building at 1970 Sutter Street has recouped $1.5 million for numerous construction defects after only 9 months from hiring The Miller Law Firm.

(Logo: http://photos.prnewswire.com/prnh/20120418/SF89665LOGO-b)

The 19-unit residential building is located in the neighborhood where lower Pacific Heights and Western Addition converge.  The settlement was reached in mediation and is being funded by insurance companies for the builder, 1960 Sutter, LLC, the general contractor, Nibbi Brothers Construction, and window manufacturer Milguard Manufacturing, Inc. Failure of weatherproofing systems on the stucco siding, roof, windows, decks and doors, with water intrusion into the interior walls, floors and ceilings plagued this building. Damages of $78,000 per unit were recovered.

According to Thomas E. Miller, CEO of The Miller Law Firm, "This Association came to us after having been in litigation for nearly three years with no trial date and no resolution in sight.   Consumers should know that construction defect claims are a highly complex area of the law and the expertise needed to obtain a timely recovery is key."

Jeff Ho, President of the 1970 Sutter Street Owner's Association, states, "Getting a second opinion on the progress of our case was key to helping us determine that a viable alternative did exist to return a favorable recovery in a reasonable amount of time."

According to Karen Katz of Property Management One, "The serious defects and frequent repairs that this building faced were overwhelming.  Having this claim resolved with a recovery that will let them rebuild is important to the owners and to the community."

According to Rachel Miller, Senior Partner of The Miller Law Firm, "Associations who simply need advice turn to us every day.  These communities show such relief in hearing that it is possible to resolve a claim in a reasonable time frame.  Associations do have a resource."

Thomas E. Miller and Rachel M. Miller of The Miller Law Firm (www.ConstructionDefects.com) are the co-authors of, "Home and Condo Defects:  A Consumer Guide to Faulty Construction," (Seven Locks Press, 2012), available online at  www.amazon.com.

Tremco Launches One-Coat, Low-Odor Deck Coating

http://www.tremcosealants.com/news-events/news/vulkem-oc810.aspx

A durable, one coat, low-odor deck coating solution is now a reality for light pedestrian traffic areas such as balconies, roof terraces and mechanical rooms. The culmination of a two-year R&D initiative, Tremco's Vulkem OC810 Coating is a high-solids, aliphatic urethane membrane designed to be applied in one 35-40 mil coat for aesthetically pleasing, durable waterproofing protection that is mildew- and fungus-resistant and low VOC (less than 30g/L).

Unlike traditional base and top coat applications that can take several days to apply, the appropriate Tremco primer and innovative Vulkem OC810 coating can be applied within the same day, allowing contractors and building owners to shorten construction timelines, realize labor cost savings and minimize the impact on occupants of inhabited spaces. Tremco Rubber Aggregate 12-20 mesh, a specially engineered system, is used with Vulkem OC810 to impart skid resistance and provide additional surface texture.

Vulkem OC810 will be available in the standard Vulkem Deck Coating colors of beige, maple, limestone, gray, and slate gray. The product is compatible with Vulkem 191 Low-VOC Primer (for exterior applications or applications where odor is not a concern) and TREMPrime MSUP Primer (for interior applications or applications where odor is a concern).

HIDDEN HOLES IN WOOD FRAMED BALCONY CONSTRUCTION

By Rocco Romero RA       Wiss, Janney, Elstner Associates, Inc

For more articles and information, see us at www.deckexpert.com.
I found this article while on a Google search. This is good info for
everyone on this list.

Excerpt-Balconies offer an important benefit of
living in a multistory apartment and condominium
building by extending usable living
space to the outdoors. In some cases, exterior
elevated walkways act as corridors to
provide access for residents to their units
and include stairways that are also exposed
to the elements. The desirable exterior exposure
of balconies and corridors also creates
a challenge in controlling water leakage.
Poorly detailed and constructed transitions,
interfaces, and penetrations often lead to
water intrusion into the occupied tenant
spaces of the building and may also result
in substantial distress to the building’s
exterior walls and structure.
In woodframed
balcony and exterior
elevated walkway construction, detailing at
transitions, interfaces, and penetrations is
often the most challenging and critical
aspect of waterproofing system design.

 Job Profile-Mariners Inn-Cambria

YOU OTTER SEE IT!

The aging Mariner’s Inn was showing it’s wrinkles. Sold off to a new investor, the motel underwent a quick redo for the summer season while plans are drawn for a new hotel to be built in a few years.

In the meantime, the main attraction, the second story view deck needed major repairs. The ocean views are great, whales spouting off the coast were keeping us enteertained while we worked, otters and pelicans, gulls and terns are in abundance!

The job started with a tear off by the general contractor of the old decking, down to framing. Repairs to the framing and sloping installed via rip strips and new plywood solved that problem.

We then flashed the deck edges, then we installed Desert Crete decking over the lath as it was put down to isolate it from any salt air.

Rick Low of Associated Development Services loves the new decking system. Desert Crete is Class A rated as a fire retardant deck, holds up against use and abuse and provides a cost effective waterproof roof over the lobby area too.

Desert Crete was selected as the best choice for this hotel over competing systems offered by local contractors. Let me show you why you should select Desert Crete too.

Business Opportunity for Builders to Make the Duradek Difference

Duradek, the leader in vinyl deck waterproofing, has nearly
40 years of experience protecting roof top decks, patios,
balconies and more all over North America. While Duradek is
certainly proud of their 3rd party tested and roofing approved
vinyl products, it is the network of professionally trained waterproofing experts who install
Duradek that make it the most reliable option for protecting your outdoor living space.

While Duradek is confident that their vinyl is simply the superior choice when
compared to similar products on the market, Duradek president John Ogilvie
will be the first to say that no matter how great a waterproofing product is -
he true performance relies on the intricate details of its installation. That is
why Duradek in only available through ournetwork of approved, trained installers.

Duradek Opportunity for Your Own Business

If your background as a builder, roofer, remodeler or contractor has
you searching for an opportunity to build a solid business foundation
with a reliable product, you may want to give Duradek some consideration.
We asked Duradek Sales Manager, Kevin MacMillan, a few key questions fo
r those of you that might be interested in becoming a Duradek dealer.

1 – What makes a good Duradek Dealer?

A good Duradek is someone who recognises that there is more to a
deck that just a landing area. When a potential dealer wraps his mind
around the fact that a deck is an extension of your living space, he is
better equipped to offer options on how to make that space as
functional, cost effective and beautiful as possible. Typically a Duradek
Dealer is someone who thinks outside of the box – an entrepreneurial
person with strong conviction.

2 – What are the advantages of being a Duradek Dealer?

The advantages of being a Duradek dealer are that you are involved in
a fun, fast-paced and innovative niche sector of the construction industry.
That is all to say that the competition is not extreme and the market is
good. Duradek HQ offers free training, marketing support, national trade
show exposure, extensive technical support and prolific web presence/exposure.

3 – How much training and investment is required?

Duradek Dealer Training in ProgressDuradek does not charge for training or for a dealership from our
head office location. However it is up to the individual companies
interested in Duradek to come to our training facility in Kansas City, MO
or Vancouver, BC. There is also the possibility of training for a reasonable
fee at one of our established Distributor areas. The training is a full 2 day
experience with about 80% of the time with the tools in your hands. Once
you have the basic training under your belt, you are ready to install Duradek.
The Marketing department will then advise you on how to take advantage
of our web-site, our literature and our people.

Considering a Business Opportunity with Duradek?

If these few considerations have intrigued you and you would like more
information on Duradek Dealer opportunities, we invite you to look a little
closer at what makes the Duradek difference. Call Corporate Development
Manager, Kevin MacMillan at 1-866-591-5594 and he will be happy to answer

any questions you might have.

If you are not looking for a business opportunity, but recognize that
Duradek can beautifully protect your own deck, contact one of our
specially trained dealers in your area for a no-obligation, free estimate
and see first-hand what makes the Duradek difference.

From Davis-Stirling, A Reader Wants to Know About Tile on a Balcony...

Yes yes, who pays for balcony damage? Well, I won't wax philosophical on that,
but I'll tell you that we can fix 'em after.See our highest ranking page about tiled decks here
 http://centralcoastwaterproofing.com/tile-deck-waterproofing/

WHO PAYS FOR
BALCONY DAMAGE?

QUESTION: Who is responsible for paying for the deck when the
owner tiled it without approval? The HOA or the owner?

ANSWER: The owner. However, the owner could have some defenses
depending on the situation. To minimize any defenses (or avoid the
problem altogether), boards should adopt written rules and regulations
regarding the tiling of balconies and then strictly enforce those restrictions.
Associations should either (i) ban tile altogether or (ii) implement tough
installation guidelines pursuant to a consultant's specs written specifically
for the association. In addition, the association should record a covenant
making the owner (and future owners) responsible for all maintenance and
damage that may arise from the installation of the tile.

Wanke, Industrial Commercial and Residential, WP Solutions Suit Ruled on.

A California appeals court on Thursday found in a trade secrets dispute that a lower court erred in ruling that a stipulated injunction barring former Wanke Industrial Commercial Residential Inc. employees from soliciting some of the waterproofing system-installing company's customers was invalid and couldn't be enforced.

Wanke in 2008 brought a trade secrets suit against former employees Scott Keck and Jacob Bozarth after they started a rival waterproofing business. The parties later entered a settlement in 2009, and the former employees agreed to a stipulated injunction, which prohibited them from soliciting Con Am Management Corp., AV Builders: Saratoga West and anyone else on Wanke's customer list.

The case is Wanke Industrial Commercial Residential Inc. v. Superior Court of San Diego County, case number D058825, and Wanke Industrial Commercial Residential Inc. v. Scott Keck et al., case number D058669, in the California Court of Appeal, Fourth Appellate District, Division One.

ExtremeHowTo.com Has a Wakeup Article on Composite Decking Issues

An alert from Google brought up this article on composite decking at www.extremehowto.com.

After reading it, I'd be leary of spending big bucks on decking and labor and finding out it isn't going to last as you expected.

"Composite materials are one of the fastest growing segments in the building material industry. Just as new technologies have changed the siding and roofing segments of construction, composite materials are charging into the decking arena.

However, today questions and shortcomings are becoming evident in composite decking (C-D). Everything new should and usually does look great, but problem issues surface when composite decking materials are marketed as a universal cure-all to wood's specific problems. Rot, insects, warping, splinters, combustibility, maintenance and environmental concern for treated lumber all play into the sales."   READ MORE AT http://extremehowto.com/a-closer-look-at-composite-decking/

DeckExpert.com strongly urges readers to consider the cons of composite decking against the pro's of solid surface decking systems such as Dex-O-Tex, Westcoat ALX, Desert Crete, DuraDek, Life Deck, Enduro-Kote, Mer-Kote or any of the other Division 7 Pedestrian Traffic Coatings that offer far more.

Solid surface decking waterproofs the plywood deck and provides a dry area underneath, so it's perfect for decks over living spaces, roof decks, stairs and walkways. Over a properly built frame, the decking with proper maintenance can last up to 30+ years.

If your considering replacing an old redwood deck or a failed composite deck, consider solid surface decking instead.
