The Eastman Chemical Co. is throwing in the towel on Perennial Wood, a line of outdoor wood products preserved through acetylation rather than pressure treatment with more familiar copper-rich chemical formulations and has been distributed in the Northeast and South Atlantic regions.

The Kingsport, Tenn., company introduced Perennial Wood just two years ago at the 2012 International Builders' Show. Eastman announced at the end of January that it would discontinue the product line, leaving the acetylated-lumber business in the U.S. solely to Accoya.

After receiving reports from member contractors describing problems with 
waterproofing membranes maintaining adhesion to concrete decks, WSRCA's 
Waterproofing Committee has prepared the following Technical Bulletin to 
provide basic guidelines for evaluating new and existing concrete decks, prior to 
waterproofing. 
Factors that can affect short-term and long-term adhesion of waterproofing 
systems to concrete decks include the dryness of the deck or actual moisture 
content of the concrete, surface profile or finish, and use of curing compounds, 
surfacing agents and/or additives in the concrete mix. This bulletin also describes 
optional methods of mechanically drying wet or damp concrete decks to facilitate 
adhesion of waterproofing materials, and working with the concrete contractor to 
prevent an improper surface finish or use of concrete curing compounds and/or 
surfacing agents that inhibit drying or are incompatible with the waterproofing 
membrane.

Deck collapse victims sue homeowners group and builder

Deck collapse victims sue homeowners group and builder


A group of family members who were injured in a deck collapse during a December Christmas party in Floyd County now are suing the homeowner’s association and a homebuilder for negligence.

Barbara and Alexander Latuch of Charlestown and 23 relatives filed suit this month in Floyd Superior Court claiming Wolf Lake Homeowners Association Inc. and Schuler Homes Inc. failed to properly inspect and maintain the deck. They’re seeking unspecified damages for medical expenses, pain and lost wages.

Several video images taken by surveillance cameras document the moment when the deck gave way and family members crashed on top of each other onto a concrete patio a story below, beside a large, covered swimming pool.

DURADEK Announces Winner Of "Best of Duradek" Contest

In honor of our 40th year in business and in recognition of the wonderful customers that have chosen Duradek as their deck waterproofing product, we held a 'Best of Duradek' contest (January 17 – February 23, 2014). We invited home owners and Duradek installers to send us pictures to show-off their decks and let us know what they love about their Duradek decks.

The random draw from all entries received was held on Monday, February 24th and the lucky winner of tickets to today's Canucks game and dinner for two was Jane Jamieson of Surrey, BC.

Jane sent us in this photo of her deck that is protected with Duradek Classic Barley with this wonderful comment:

 "Here is my deck ( in winter not being used mode ) with Duradek product on the floor…I had this installed in the mid '90′s and it still looks like new! I have power washed it but now use 'The Duke' to clean it and I think it does a better job than power washing. The deck always looks great and I have never had to do repairs and love the low maintenance!! Definitely would use again."

Men Who Scammed CSLB Applicants, Licensees
Sentenced to Jail

Two men plead guilty to conspiracy, ordered to pay victim restitution

SACRAMENTO — The Contractors State License Board announces that a second man has been sentenced to jail after scamming licensed California contractors and those attempting to become licensed.

Maico Merdinand Dilma, believed to be residing in Mexico, pleaded guilty on February 18, 2014, in Sacramento County Superior Court to a misdemeanor charge of conspiracy to cheat/defraud another person of property (Penal Code §182(a)(4)). He received 120 days in jail, three years of probation and was ordered to pay restitution to the victims.

Dilma was arrested in December 2013 following a multi-faceted investigation that began in the summer of 2012 when a number of license applicants told investigators they were conned by people falsely representing themselves as CSLB employees. Applicants were told they needed to purchase examination study guides, while licensees seeking an additional trade classification were told they needed continuing education credits or licensing exams, and needed to pay with a credit card over the telephone.

Luis Manuel Flores, of San Diego, was arrested in February 2013 while entering the United States at the California-Mexico border. He pleaded guilty to a felony charge of PC §182(a)(4) and was ordered to 180 days in jail and five years of probation.

Investigators determined that Flores and Dimla created a fraudulent business and website with names similar to CSLB. While in the Tijuana area, the two contacted CSLB applicants and licensees with phone numbers that appeared to victims as originating from the 916 area code (Sacramento area). At least 50 people were defrauded, in amounts ranging from $98 to $250 each. The number of victims may increase once people realize they were conned.

“Our consumer protection efforts go beyond those who hire contractors,” said CSLB Registrar Steve Sands. “We take very seriously any attempt to con or take advantage of our licensees or those who apply for a contractor license.”

CSLB issued an industry bulletin and a prominent alert on the CSLB website to warn contractors and applicants about people claiming to be from CSLB and asking for credit card information over the phone. They also were reminded that CSLB fees only are payable through the mail or at CSLB Headquarters in Sacramento. The warnings dramatically cut the number of people being victimized.

The Contractors State License Board licenses and regulates California's 300,000 contractors, and is regarded as one of the leading consumer protection agencies in the United States. It operates under the umbrella of the California Department of Consumer Affairs. In fiscal year 2012-13, CSLB helped recover nearly $44 million in ordered restitution for consumers. The agency overseeing companies that build houses and office buildings across California has for years trumpeted its ability to sniff out phony contractors, often publishing photos of dramatic undercover police stings of unlicensed builders at work on half-finished suburban cul-de-sacs.

But now the agency, the Contractors State License Board, is looking into a problem of the state’s own making — a program that allows contractors to essentially lease out their licenses.

The board has allowed some licensed contractors to earn extra income by supervising as many as three projects across the state. In some cases, licensees would have to travel hundreds of miles to oversee work performed by others, which experts in the field say could pose liability problems.

Decks with coatings on them are roofs first IMO, and HOA's SHOULD NEVER make the decks the responsibility of the owners. There's so many reasons I could write a book about it...but that's for later on. One note, David should say that a deck waterproofing contractor, FOR A FEE, can make inspections of the Associations decks.

I know that many condominium association boards of directors contemplate the idea of making owners responsible for the waterproofing on the balconies or decks in condominiums (and yes, generally the association is responsible for repairing or replacing what is considered common area waterproofing). Bad idea. The reality is that owners will not do what is required to ensure that the waterproofing is properly maintained and the resulting leaks will allow water to damage the common area and other units. One association client learned this the hard way.

It all started with that association amending and restating its Governing Documents. As a part of that process, their former attorney suggested that they make the homeowners responsible for the maintenance, repair and replacement of the waterproofing on each homeowner’s exclusive use balcony decks. Many associations tell me they would like to see the homeowners responsible for the waterproofing, as they claim that the association does not want to have to save or expend the money for that work. However, in practice this is not a good idea.

The fact is that homeowners are not really that good at maintenance. Many owners move into condominiums so that they can avoid having to do that kind of work. Most waterproofing systems require some form of recoating every three (3) to five (5) years. Homeowners do not understand waterproofing systems, and neither do most boards at condo associations. At the association that was involved in the lawsuit that is the subject of this article, a prior owner of a unit had ongoing leaking issues with his large balcony deck. To resolve the leaks, he made substantial modifications to the waterproofing system. He then sold the unit. His modifications had not resolved the leak issues.

Make Sure Your Deck is ICC-ES Evaluated

There's a lot of deck coatings out there...so why aren't there that many at ICC-ES website where Division 7 Pedestrian Traffic Coatings are listed? 

Because many of them haven't tested their systems at independent labs where their deck coatings are burned, heated, chilled, blown on and abraded, denigrated and abused. Probably because they know their coatings wouldn't pass the srtingent required battery of tests that must be passed to become a real deck coating.

A Yelp Review Leads to A Lawsuit, Which Results in Defamation Judgement Against Reviewer

A contractor's client wrote a bad review on Yelp, Angie's List and several other sites. Whether the women's statements  was opinion or fact becomes the crux of the matter and the result was a lawsuit and the reviewer was found to have defamed the contractor. A scathing Yelp review and accusatory reaction posts in the comments—Virginia homeowner Jane Perez and local contractor Chris Dietz were playing the online reputation game for keeps. Initially, Dietz's work led to Perez's review, which resulted in Dietz's lawsuit for defamation. And as Arspreviously reported, it was a complicated matter. In December 2012, a lower court ruled that Perez was required to edit her harsh comments on Yelp and Angie’s List against Dietz and his company, Dietz Development. But then Public Citizen and the American Civil Liberties Union filed a 21-page petition for review to the Supreme Court of Virginia later that month, and the highest state court overturned the injunction just two days later.

Did You Know That Dex-O-Tex's name came about as a contraction of "decks of latex"?

On my list of I didn't know that...comes the history of Crossfield Products and their Dex-O-Tex decking.

Crossfield Products History


In the early part of the decade of the 1930's, a British Chemist by the name of Crossfield had developed a formulation for mixing natural rubber and cement (which are not compatible by nature) to be used as a sloping compound and underlayment for ocean going vessels. Crossfield's company was called Surfacing Products. In 1938, a group of investors purchased his company and formed Crossfield Products Corp. During World War II, natural rubber was put on allocation and, at the same time, synthetic rubber polymers came into play. Crossfield Products adopted the new technology and began using polymer modified concrete on both the interior and exterior of ships such as the Queen Mary, the SS America and the Queen Elizabeth. It also began offering these products to the U.S. Navy.
To identify this family of products, the company coined the trade name Dex-O-Tex® which is a contraction of the term "decks of latex". Dex-O-Tex® has become synonymous with quality construction chemicals with worldwide distribution.

Although the marine business was its core, the company began to explore uses for its polymer modified concrete products on land. In the 1950's the company added polymer modified terrazzo and a patented flexible roof deck surfacing material. In the 1960's the company added epoxy resin technology to its product offering, eventually coming out with a complete line of fluid-applied flooring for heavy duty, high impact areas of use.

Later, chemical technologies such as Urethane Concrete, Polyapartic and Polyurea were added, making Crossfield Products Corp. the go to company for the most diversified product line of construction coatings. The company prides itself on its lasting experience in developing state-of-the art systems, precise manufacturing capabilities and excellent marketing of its brands.

Westcoat's ALX System ICC-ES Report Has Been Updated-Now One Hour Rated + More!

We just received word that Westcoat's ALX system has a new ICC report behind it. President Paul Koury, in an email to us here at DeckExpert.com, provided the news that their ALX system has been recognized after testing and evaluation to be a "One Hour" Fire Rated Construction system as well as now being recognized as Class A roofing with their WP-40 sheet membrane under it.

With this news we will now be retracting our earlier reports from several years ago where we had great concerns over the use of peel n stick membranes under the ALX system for use when a Class A rated roofing deck system is required.

Westcoat ALX has been tested and evaluated and is code compliant with the 2012, 2009 and 2006 International Building Code as well as the 2012 2009 and 2006 International Residential Code. 

Westcoat tested their ALX system with their custom stain/sealer finishes as well and this information is included in their updated report. 

I keep hearing stories from manufacturer's who have been going through hell with ICC-ES to get their products evaluated...congrats to Westcoat for sticking it out and getting their updated report.
