FEDS SEARCH MORE BUSINESSES IN FRAUD CASE IN NEVADA....

Agents pursue HOA records

Board members, lawyers, construction firms scrutinized

In its sweeping investigation into homeowners associations, the federal government is digging up documents and correspondence related to association board members, attorneys and construction companies, according to a search warrant issued in the probe.

During searches of seven common-interest communities governed by homeowners associations, FBI agents sought ballot lists, ballots, envelopes and nomination forms.

Authorities are investigating whether individuals were planted on homeowners association boards to funnel business stemming from construction defect lawsuits to certain attorneys and construction companies.

In one case, according to a source close to a construction company alleging it was frozen out of the bidding process to fix construction defects, the owner of a property management company referred so many cases to the same law firm she was rewarded with a trip to Cabo San Lucas.

Agents are searching homeowners association records and ballot information dating back to 2001. The properties listed on one search warrant include Vistaña, Chateau Versailles, Pebble Creek, Park Avenue, Sunset Cliffs, Chateau Nouveau and Mission Pointe.

The government also seeks seven years of correspondence involving 43 people including Lisa Kim, president of the property management firm Platinum Community Services, which was raided by agents Wednesday. Some of the others include current and former homeowners association board members around the valley.

An attorney for Platinum, Blaine Beckstead, said Thursday that the warrant Platinum was served with on Wednesday did not include the names of Kim or any other Platinum employee. The Review-Journal verified Thursday night that Kim, who could not be reached for comment, was not listed on the warrant served at that location.

Agents are also interested in documents related to political consultant Steve Wark, who served as president of the Vistaña Homeowners Association, as well as prominent construction defect attorneys Scott Canepa and Nancy Quon.

Being named in a warrant does not necessarily mean individuals were involved in wrongdoing. No arrests were made as a result of the raids.

Canepa and Quon were unable to be reached for comment.

Wark did not sound surprised that his name was listed in the warrant. He was president of the Vistaña homeowners association between late 2005 and fall 2007, he said.

Quon was one of the attorneys who represented the association in its 2005 lawsuit against Rhodes Ranch. The company fought Rhodes over faulty plumbing and other problems.

"I was president of the association, and I would expect at some point that people need to talk to me," Wark said.

He said he wasn't involved in any wrongdoing and that he has not been contacted by law enforcement.

Search warrants were executed Wednesday on nine valley properties, including a building on Bertsos Drive, near Flamingo Road and Arville Street, which is owned by Silver Lining Construction owner Leon Benzer. Federal agents are also after contracts and invoices related to Benzer's construction company.

But a source close to Silver Lining Construction said that the company was not involved in any wrongdoing.

Instead, the source said, it was another firm, Draeger Construction, that monopolized the construction defect rehabilitation industry, freezing out other bidders.

According to the source, competitors of Draeger, including Silver Lining, are looking into filing a federal anti-trust lawsuit against the construction company, property managers and attorneys. The gist of the complaint is that Draeger has monopolized the market because it is in cahoots with the property managers and attorneys.

Draeger Construction is listed in one of the warrants.

A message left for Draeger representatives was not returned Thursday.

According to the source, one property management company, Castle Management, referred all construction defect complaints to a local law firm which would then suggest to the homeowners board that it hire Draeger Construction to do tests and make repairs.

Other competitive bidders, such as Silver Lining, are not even considered even though they may offer the best deal, the source said.

At one point, the law firm treated Castle Management owner Diane Wild on a trip to Mexico, the source said.

Wild did not return calls seeking comment.

Draeger Construction landed the jobs in part because it showered homeowners association board members with gifts, the source said. But it also pitched itself as the only company that could provide properties with certain materials, weeding out other bidders.

We had the headers for those boards adjusted immediately when the error was found and we've been looking for the boards (one which you have found) to replace them. So I got a call last week from a client in Grover Beach; she'd had her deck redone by a local company a couple years ago.

She said "there's rust coming through from the chicken wire". I rushed right over...

The patient had signs of serious distress; rusted lath all over the deck. Close examination and an autopsy revealed what looked to be Tufflex or some type of urethane troweled over the lath. Some sloping work was done, we could see the built up materials over an old existing fiberglass system that went over the original urethane surface we found buried down below...

The deck was flat in many areas, attempts at crickets to move water to the scuppers were done poorly, water ponded on the deck just from the heavy fog we get on the coast in corners adjacent to scuppers, and out on the field of the deck.
Clearly who ever did this was guilty of not knowing what they were doing...

Demo'ing the stucco walls, where i could see the flashing was rusting through, we found serious amounts of water damage to the plywood and metal. Removing the plywood in one corner revealed the damage below to the TGI Trusses (Engineered Truss System, uses wood and OSB for strength).

This brought our work to a screeching halt; a general contractor will be needed to fix this problem, then we can come back and waterproof.

This job for us is around 10K, the owner now faces another 10k in wood repairs before we can waterproof her properly...

Lesson, you can cheap out on your job, but your job won't get any cheaper!

Do it right the first time, not the second or third.

Another Condo Project Slides Into Oblivion in SLO County

In the Tribune this morning, there is an article on Southside Condo's, which has had work stopped for over a year now, has had it's lender file suit against the builder.

Charnley Development/Pembroke Builders started the project several years ago, when the heady days were around...I actually sold the decks and stairs on the project through a company I worked for.
We did three buildings, 2 were 100% completed and the 3rd was 75% done when work stopped.

Sun scorched building paper is drying out, plywood and trim is cracking and drying out. When/if this building ever starts to go again, it's going to need some help to ensure deteriorating materials are removed and replaced...

Rabobank has filed for payment of 7 million, the Trib said an appraisal of some sort valued the property at 3.5 million. Huh...and there's the poor folks who bought a unit and are stuck probably...and then there's this huge eyesore of a lot, and an unfinished building...

Massive Fraud in Construction Defect Litigation in Nevada?

FROM NEVADA, a story of massive alleged fraud involving construction defect litigation, steering jobs to "preferred" contractors, law firms in cahoots with the management company...all brought about by a raid by the FBI.

Federal and local law enforcement officers raided nine sites around the valley on Wednesday in a sweeping probe into possible collusion between homeowners associations and businesses benefitting from construction defect lawsuits.

The raids are part of a "pending public corruption case," according to Federal Bureau of Investigation spokesman Dave Staretz, who refused to release details. He said no arrests were made.

According to a law enforcement source, the FBI is investigating whether individuals were placed on homeowners association boards who, in turn, would direct business stemming from construction defect lawsuits to select companies.

At issue, according to the source, is whether HOA members were steering contracts to certain construction companies.

Other sources said there has long been speculation that some HOA representatives were hiring certain law firms to handle construction defect lawsuits in exchange for kickbacks.

State Sen. Mike Schneider, D-Las Vegas, a lawmaker who has been involved in homeowners association issues before the Legislature, said the speculation involved management companies steering construction defect business to law firms in exchange for kickbacks.

One of the companies raided Wednesday by FBI agents and Las Vegas police was a business in an industrial area near the Palms owned by Leon Benzer, who is involved in a variety of businesses.

Idaho company owed about $200,000 for work including architectural metal roofing, deck coating and water-proofing a garage roof.

Contractors have filed 77 liens against Tamarack Resorts in Idaho for more than $22 million in unpaid bills, according to Credit Suisse, the Swiss bank that began foreclosure proceedings against Tamarack last March after the resort defaulted on a $260 million loan. Companies owned by Tamarack principals Jean-Pierre Boespflug and Alfredo Miguel Afif filed for bankruptcy protection to block this and other foreclosures.

The liens range from $3,000 for the installation of three computer-designed steel garage doors at a parking garage to $1.4 million for work performed on the condominiums at Tamarack Village.

Another developer going belly-up and leaving subs who can ill afford the losses....nice.

Roofing, Waterproofing and the Building Envelope

PLEASE NOTE THAT THIS CLASS HAS BEEN CHANGED FROM ITS ORIGINAL DATE OF AUGUST 18TH.
The new California building code, which became effective statewide on January 1, 2008, is based on the 2006 International Building Code and not the 1997 Uniform Building Code that we have all become accustomed to using for the last 10 years.

The new IBC and CBC have many specific changes that effect roofing, waterproofing and building envelope professionals. Most significantly, the old Codes generally required that the construction (builder) prevent water intrusion to the interior. The new Codes have been changed to make them more stringent and specific. Language has been added in the Codes that requires both "design and construction" to meet the intent of the codes, not just construction. As a result, the new codes shift more liability on the design professional, requiring them to properly design the building envelope systems. In regards to water intrusion and water damage, new codes include vapor barriers and vapor migration within an assembly. This seminar will include a side-by-side comparison between the old code and new code as related to roofing, waterproofing, exterior walls and building envelope systems.

Here's a nice article in this months Journal of Light Construction's September 2008 issue on the installation of a Duradek membrane on a plywood deck in New Jersey...written by the general contractor of the job, Rob Corbo, it does a good job of explaining the process and showing detailed pictures of essential elements of the installation.

The one item I nit picked about is that they put the seam at the outside edge of the deck...to hide it under the railing. Logical choice for hiding it, but my thought is that the water running off could get trapped at the welded seam, where I'd arther have the seam at the inside wall area, and a nice 54"wide run let water run freely right off the edge without that possibility...

Rob does a nice job on his article and it certainly shows the relative ease of installation (Remember all you who might want to try installing waterproofing, the devil is in the details) of the Duradek membrane. You can purchase the aricle or subscribe to JLC and get 12 months of great issues chock full of valuable information!

It's worth the subscription price to me for one article that saves my you know what from getting into trouble!

Florida Community Association Journal's September issue features article on concrete balcony replacement & compares the costs on 2 methods of replacin


Project Enginer Sean Kauffman of Structural Preservation Systems LLC in Pomono Florida compares the costs involved with the very expensive task of concrete balcony replacement in his article just published this month in FCAJ.

His case study involves two fairly typical Florida style condo's-those being built with concrete balconies instead of a traditional wood framed/plywood covered deck.

Concrete sounds great and really is a product to build with, but like any product, needs to be protected. Wind driven, salt laden rain, (hello, Hurricanes and tropical storms) drives deep into concrete, attacking the rebar. Once rebar begins to rust, it's only a matter of time before you'll be spending big bucks to replace failing spalling balconies.

Now many high rises are being waterproofed with various products when they are being built...but there's a lot of condo's out there that will be doing balcony replacement and they would be wise to read this article. Comparing the traditional, or conventional method (every third balcony) to the Full Stack, or Simultaneous Method of Repair, Sean details out the methods and the costs of each, including the extra hidden type costs that can drive number sup, to show that the Full Stack method saved significant man hours on demo, 1267 hours of savings!

Desert Brand Announces Price increases, Becomes Latest To Do So...

Is Life Paint in Violation of ICC-ES's Rules for Use of an Evaluation Report?


ICC_ES issues evaluation reports, they do not "approve" a product for any use whatsoever...that's what a Building Official is for, to determine if a product is suitable for the job it's going on.

ICC-ES evaluates a product and the test data it is provided from accredited labs that have performed the required testing protocols that must be done. Therefore, ICC-ES has written specific rules about the use of their reports, what claims a manufacturer can make regarding a report it may hold and the wording that can be used.

From ICC-ES' Rules of Procedure for Evaluation Reports under 13.4. "It is the report holders responsibility to not misrepresent the evaluation report in any way, and to secure ICC-ES approval in advance whenever there is a question about the use of the ICC-ES name and/or ICC-ES evaluation report. Report holders are expressly prohibited from using in advertising, promotional and informational materials, such language as "ICC-ES Approved", ICC-ES certified etc.

So imagine my surprise when I was down at Miners Ace Hardware and saw the new Life Paint/Life Deck AL system on a very nice display board along with their FM system and Texture Crete...can you spot the apparent violation?

New Mexico Gets a CAI Chapter

ALBUQUERQUE, N.M., Sept 08, 2008 /PRNewswire-USNewswire via COMTEX/ -- Thousands of New Mexicans who live and work in homeowner and condominium associations now have a statewide organization dedicated to issues and challenges faced by these common-interest communities.
Community association leaders in New Mexico have established a chapter of Community Associations Institute (CAI), a national, nonprofit group that works on behalf of associations and their residents. The New Mexico chapter will be headquartered in Albuquerque. The national organization is headquartered in Alexandria, VA.
CAI estimates that 60 million Americans live in close to 300,000 associations nationwide.
Dozens of community association leaders in New Mexico have been involved in the effort to establish the new organization.

One Of My Competitors is Welcome to Do This Job...



One of my biggest frustrations in the field of waterproofing is the lack or respect and appreciation of my trade...

Today I went to look at a job that I received a lead on yesterday; a nice job that needs waterproofing for tiling over. It was way out in the back country of SLO County, off Huer Huero Rd in Creston. Big ranch style house, certainly a million dollar home.

The contractor, who shall remain nameless to protect the guilty, when he was on the phone with me became a little belligerent when he asked me what system I would use... He said "I know what Deck Tech (a local competitor in Grover Beach) does for tile, what do you do?"

I simply told him that until I looked at it, I wouldn't know, nor make a decision on until I got there. So off I went this morning, out Hwy 58 through Santa Margarita out to Creston. I arrived at the house to find what you see in the pictures...

The contractor told me that they were putting on a 1 1/2" mortar bed over my waterproofing to put the tile onto. I said can I raise a couple questions? Sure, he said, go ahead...

Well said I, there's a few issues that need to be addressed..."I don't believe the substrate and framing are suitable for tiling over...it's 2" x 8" construction, it's 3/4" OSB over that, and the joists are only 16" on center. Plus your OSB is not an approved substrate for waterproofing over, it's in upside down, and it's not gapped. Plus there's no blocking at the seams . My opinion is that you need 2" x10" framing, 10" on center, and you need to have at least another 5/8" sheet of plywood on top. I think they'll be deflection, which will cause the tile to crack, the waterproofing to fail, and we both get sued..."

That's when the contractor told me that he didn't need my services...whew! Like I was going to take this job as it was and accept the risk of this job failing...

So off I went, thankful I am smart enough to walk away from idiot contractors who think they're smarter than me. There are still 4 more companies in the phone book for him to call...one of them I'm sure will be hungry enough for work to allow them to ignore the signs of trouble.

Ariz. ruling finds leeway for home defect suits

PHOENIX -

Arizona homeowners don't have to buy directly from builders to sue them for defective work, the state Supreme Court ruled unanimously in a case with implications for consumers and businesses alike.

"Innocent buyers of defectively constructed homes should not be denied redress on the implied warranty simply because of the form of the business deal chosen by the builder and vendor," Justice Andrew Hurwitz wrote in the unanimous ruling Tuesday.

The ruling in a high-profile business case that attracted interest from industry, homeowner and consumer groups revives a lawsuit filed in connection with a Phoenix lofts project.
