Ohio's AG suing Northeast Ohio contractors - Basement Waterproofing Contractor Accused of

Ohio Attorney General Mike DeWine has announced lawsuits against two Northeast Ohio home improvement contractors.

The lawsuits accuse Mark Walker of Avon, and his business, All American Restoration, and Wayne Given of Silver Lake, doing business as Basement Waterproofing Solutions, of failure to deliver and performing shoddy work.

"When consumers pay thousands of dollars for home improvement services they never receive as promised, there's a problem," DeWine said. "We are committed to enforcing Ohio's consumer protection laws and holding violators accountable."


Wayne Given operated Basement Waterproofing Solutions from his home in Silver Lake, Ohio, offering basement waterproofing services. Consumers complained that the business failed to deliver or did shoddy work. Reported losses totaled approximately $12,900 for three consumer complaints.

Supervisor jailed, company fined after worker dies

Roofing Medics Ltd. fined $50,000 after worker killed in fall

Roofing Medics Ltd. was fined $50,000 and its supervisor Paul Markewycs jailed for 15 days after a worker was killed in a fall from a residence in Toronto.

The roofing installation company — based in Brampton — was found to be in violation of Ontario's Occupational Health and Safety Act after a worker installing waterproofing materials from a ladder lost his balance and fell. The worker fell about six metres and struck a fence. The employee was taken to hospital and pronounced dead an hour later.

"I hope this jail sentence sends a chill down the spine of every boss who puts profit ahead of workplace safety," said Ontario Federation of Labour (OFL) president Sid Ryan. "Every year 80 Ontario workers are killed in workplace tragedies and nearly 250,000 more are maimed or injured. The only way to stop this carnage in the workplace is to march negligent employers from their boardroom to a jail cell."

Exposed Waterproofer in NJ Buys His Nemesis' dot com Web Names, Redirects Them to XXX Sites

A New Jersey businessman was so angry about an article that ran the Newark Star-Ledger, he bought the editor's Web domain name — then redirected users to a hardcore porn website to get revenge, a new lawsuit claims.

Editor Kevin Whitmer claims the paper ran a series of negative articles between 2010 and 2013 about waterproofing company owner Alfred Demola, exposing his allegedly shady business practices such as not returning customers' deposits.

JLC LIVE's Educational Tracks in Portland Puts a Lot of Emphasis on Decks!

W02 - Deck Design Application Workshop and CAD Software

There must be 40 design applications out there. Which one is easy to learn? What can give me the edge over the other deck builders? How much does it cost? If you still draw your decks on paper, it is time to come to the 21st century. We will explore most of the CAD software available, what they do well, what they can't do, and what you can make them do!  Break out of the box. There's more to deck design than right angles. In this session you will learn how to:


• Utilize CAD software effectively
• Use simple geometric shapes to create something unimaginable
• Advance your bottom line by learning how to give your clients numerous design options

W05 - Construction and Waterproofing Methods for Walking Decks and Tile Covered Decks

Waterproofed decks and/or tile-covered waterproof decks rate high on the list of components claimed to have construction defects. Sadly, many of those claims are true. This session will teach you the best construction practices needed to keep you and the deck contractor out of the court room. The first half of this session will discuss pedestrian deck systems and the best building practices necessary to construct a well built long lasting deck assembly. After, time for Q&A and the second half of the session continues with instruction on tile roof decks and how to properly build and waterproof them for a system that will last 30+ years. From Fire Chief- Congressional leaders, builders to discuss home vulnerabilities to wildfires

Saw this on a blog site...hope they are going to talk about decks and how concrete coatings can reduce the possibility of homes igniting...

"On November 12, the Insurance Institute for Business & Home Safety (IBHS) and the BuildStrong Coalition will meet with congressional leaders at the IBHS Research Center in Richburg, S.C., to explore solutions to make the U.S. more resilient to natural disasters. Rep. Bill Shuster [R-PA], chairman of the House Transportation and Infrastructure Committee, and Rep. Lou Barletta [R-PA} the chairman of the Subcommittee on Economic Development, Public Buildings and Emergency Management, will lead a congressional delegation to tour of the research center and observe a demonstration of home ignition vulnerabilities in the 38 states that are at risk to wildfire, the IBHS said."

Excellent Coatings (Finally) Gets an Updated ICC-ES Report-Tufflex II Listed as "Additional Listee"

Excellent Coatings has an updated ICC report under  Division 7 Pedestrian Traffic Coatings. 

The new report replaces their old "Legacy" report, leaving only Life Paint with a Legacy report  listing.  I've heard several manufacturer's tell me that it's taking ICC an eternity to evaluate reports.

Mr. Condo Discusses Sliding Doors to A Deck - Limited Common Element or Not Is The Question///

In 2012 our association informed us it was going to replace our sliding glass doors at the cost of $4600. Prior to making the decision the board consulted with an attorney who reviewed our declarations and by laws. He stated (3 separate times) that due to ambiguities between our declarations and by laws the association should treat the sliding doors as common elements. In January of 2013, a new board was elected and in April of 2013 issued a resolution stating that sliding glass doors (amongst other things) were not considered common elements any longer.

You think it's ethical to refer a business partner as a consultant on a matter that concerns your product? See waterproofingsuperstore partners listing attached. I'm not questioning Mark Marsch's ethics, I'm challenging your ethics in referring someone who has connections to you.  

Your wife Carol is a beautiful Russian lawyer? Wow, I thought she was a nurse with a permanently suspended license - at least according to documents online she is. Or did you divorce Carol and remarry?

  I'm flattered that you think I have a bromance with you but that's just your bi side flaring up I guess huh? I'm interested in seeing what dirt and skeletons you have that you don't want anyone to know about. 

I'd love it if you tried to sue me.
 I'd label it as a SLAPP and that's the first thing that would get heard...and then I'd post all the documents up on my site. 
I'd subpoena everything you have. And I put out the REFCO case and the Scott Schmutzer case out as proof that you are a liar. As in, "the court finds you less than credible" liar.

 So go ahead. Do it. I'd slap you down as NCS has no standing to sue in California as a suspended corporation... and I'd publish it all. 

So you see Dave the truth is  a defense and as you know it's really tough to prove libel and slander...especially in your case, you are a semi-public figure in the deck industry...and have a history. 

By the way, I never applied to be a applicator while you were there as I wasn't a licensed contractor then...and  you can try to throw Tim McDonald under the bus all day long but it won't work. When Mer-Kote got bought out, got rid of you and cleaned up, I became an applicator. 

A question...were you working for Mer-Kote as a salesperson between 6/20/1997 and 6/20/2002  while at the same time was apparently an owner with WICR? 

Another question-why when you were a member of RCI as a consultant where you using WICR's fax number? I find that peculiar.

The client is well aware of the relationship between DeckTech and myself competing against each other and they will independently verify any claims I've made through other independent experts. 

 

I will again reiterate my invitation to you to tell me what statements I've made about NCS or DeckTech are not true? I again offer to remove any statements that I've made that are shown to be untrue or incorrect. But if the statements aretrue, well the truth hurts and no one likes their lies exposed.  

 

In regards to #1 above, it seems to me I'd want to be involved when it's your product being represented...if you don't want to be involved  well, we just might report that so the buying public can consider that as part of their buying decision. 

 

In regards to #2 up above, one persons idea of causing trouble for someone is another person's idea of shining a light into the dark underbelly of your business. A client of yours via DeckTech is asking questions that you don't seem to care to answer in a forthright manner. Perhaps that's because you know what problems you'll see if you have to show up at the job? As the old saying goes, a little sunshine is the best disinfectant. You don't like what I say because you can't  refute it, you can only try to "duck and dodge" the issues. 

 

Speaking of being unethical; wouldn't you consider it unethical to recommend a current and former business partner as the "independent expert" the client should talk to? I almost keeled over laughing  when they mentioned Mark Marsch's name...

 

In regards to #3 above, I am whether you like it or not, recognized as an expert on this subject. What matters is recognition by others of one expertise and I have that so go cry in a bucket. 

 

In regards to #4 above, your goal is to not answer my questions. I understand, answering my questions would only raise more...well I'll get my questions answered one way or another. Once I get them and verify them, I'll publish them.

 

I don't need anyone's blessing to let me police the industry. I'll decide if I want to do that.    

 

All you can do is deflect the questions by trying to say I'm not properly licensed, but yet again, I'll  point out that you have a D-12 license as well...

My website,despite your opinion, is very popular and I get many compliments on it. Again, you don't like your sleazy shit being dragged out of it's hole and posted on my site for everyone to see.

 

So let me ask you a few other questions- 

 

when do you expect to have your corporate status become active again with the SOS in CA? It has been suspended for several months now...how can you operate when legally you can't? 

 

Why are you changing your name on the Nevada contractors board from Krubinski to Mazor?  Do you hold any licenses in CA under Mazor? I see one under ICR Services for Krubinski and one under "David Mazor" here in CA.

Bill, why don't you do the right thing and inform your "client" that you are actually competing against Deck Tech and can only provide a biased opinion, which is wrought with misstatements and untruths?

 

I would also greatly appreciate if you would leave me and my company alone and delete us from your email contacts.

A client of ours hired Deck Tech to install Nevada Coating Systems Extra Tough system. 

 

When Deck Tech arrived they applied a product from buckets labeled Carboline. Carboline ET 

 

Can you confirm or deny that this is an authorized product that is a suitable substitute for NCS Extra Tough or is this an unapproved substitute? 

 

Does Nevada Coatings actually manufacture product or simply resell under a private label or open source?

 

Secondly, 

It appears that the mil thickness  applied is apx 8-12 mils instead of the 45 mils minimum as specified in the tech bulletin at nevadacoatings.com
