MORAL OBLIGATION
QUESTION: I’m President of a large condo association. The board found that bills were not paid to some vendors almost 10 years ago and the vendors have written the amounts off as bad debt. However, some board members want to go back and pay those old debts. We have had a large turnover in owners. Is it fair to ask those new owners to pay for this old debt?
ANSWER: Whether legally obligated or not, the association is morally obligated to pay the debt. To not pay for benefits received when the association has the ability to do so is in effect a theft of goods and services from those vendors.

ICC-ES Revises Policy on 2009 Codes

ICC-ES has changed its long-standing policy that required evaluation reports to comply with the newest edition of the International Codes beginning January 1 of the year following publication. Effective July 1, 2010, report holders will have the option to have their products evaluated under the 2006 or 2009 International Codes, or both. The change in policy is intended to give report holders and applicants more leeway to decide when to address the requirements of newer codes, a decision that is driven by their customers and the jurisdictions in which they sell.

As part of this process, evaluation reports on the ICC-ES website will be re-organized to better distinguish the code year on which the report is based.

Job Description
ICC Evaluation Service, Inc. (ICC-ES) is the U.S. leader in evaluations of products for code compliance.  ICC-ES works with building product manufacturers, standards development organizations (SDOs), industry associations, code officials, engineers, designers and specifiers to assist manufacturers in bringing innovative products and technologies to market.  Under its current growth plan, ICC-ES is seeking applicants for the position of Technical Director.
The position would be responsible for:
  • Technical leadership including allocation of resources
  • Development and content of evaluation reports and acceptance criteria
  • Development of a highly technical, forward thinking staff dedicated to public safety and customer service
  • Representation at designated SDO and industry groups
  • Identification of growth areas and implementation of staffing and processes needed to meet corporate expectations for growth
  • Position reports directly to the Senior Vice President
Job Requirements
  • Degree in engineering, or science; a Master’s degree is preferred
  • Minimum of 10 years experience
  • Licensed engineer with preference given to structural engineers; background in seismic and wind design
  • Working knowledge of building codes and modern construction methods and materials, including their application in all types of building construction knowledge of current trends and developments in construction methods and materials
  • Excellent customer service skills
  • Excellent verbal and written communication skills
  • Ability to travel both nationally and internationally
  • Position will be located in our Whittier, California office

Individuals are expected to possess a license to practice engineering, or the ability to obtain a license within one year. From Durability & Design-Employer Found Liable for Risk to Subs’ Workers

General contractors and other job-site employers may be held responsible for violations created by a subcontractor whose workers are exposed to safety or health hazards, the Occupational Safety and Health Review Commission has ruled.
The decision upholds the Occupational Safety and Health Administration’s multi-employer citation policy and reverses a decision that the Commission itself made during the previous administration.
Under the policy, OSHA inspectors may cite employers on multi-employer worksites for violations that do not expose their own workers to occupational hazards. For example, a general contractor who controls the worksite may be responsible for violations created by a subcontractor, exposing the subcontractor’s employees to safety or health hazards.
The Commission’s Aug. 19 decision affirms an earlier decision by the Eighth Circuit Court of Appeals. The court had rejected the Commission's previous view that employers are READ THE REST BY CLICKING HERE
