CSLB Goes Undercover to Sting 11 in Woodland
Repeat offender among those caught contracting without a license in Yolo County

 

SACRAMENTO – The Contractors State License Board (CSLB), in partnership with the Yolo County District Attorney's Office and Department of Insurance, caught 11 unlicensed operators in an undercover sting in Woodland on June 8, 2011.

Members of CSLB's Statewide Investigative Fraud Team (SWIFT) posed as homeowners and invited suspected phony contractors to a vacant home to bid on home improvement projects, including landscaping, fencing, and painting. If the bid totaled more than $500 in labor and materials and the suspect was not state-licensed, they were given a notice to appear (NTA) in court to face misdemeanor charges of contracting without a license. Some also face misdemeanor charges of illegal advertising. State law requires contractors to put their license numbers in all advertisements. Those who are not licensed may advertise to perform jobs valued at least than $500, but their ads must state that they are not licensed.

Robert John Wachs, who received an NTA for contracting without a license after he bid on a painting project, is no stranger to CSLB stings. Wachs, 57, of Knights Landing, has a pending court case in October 2011, on charges of contracting without a license after he was caught during the CSLB Fall Blitz in September 2009.

"Consumers need to be aware of the risks they take when working with the unlicensed," said Registrar Steve Sands.  "This sting operation is a prime example of how violations of state consumer protection laws will not be tolerated by CSLB and its partnering agencies."

CSLB urges consumers to follow these helpful tips before hiring anyone to do work on their home or property:

·                     Hire only licensed contractors and ask to see their license and a photo ID to verify their identity. 

·                     Always check the license number on CSLB's website at www.cslb.ca.gov or www.CheckTheLicenseFirst.com to make sure the license is in good standing.    

·                     Don't pay more than 10 percent or $1,000, whichever is less, as a down payment.  There is an exception for about two dozen licensees who carry special bonds to protect consumers.  These exceptions are noted on CSLB's website.

·                     Don't pay in cash, and don't let payments get ahead of the work.

·                     Get at least three bids, check references, and get a written contract.

What's in an ICC-ES Evaluation Report

Evaluation reports from ICC Evaluation Service® are the most preferred resource used by code officials to verify that new and innovative building products comply with code requirements. The evaluation reports provide information about what code requirements or acceptance criteria were used to evaluate the product, how the product should be installed to meet the requirements, how to identify the product, and much more. ES Reports are divided into eleven major areas. Click to view
CSI Division Number—ICC-ES Evaluation Reports, and the building products represented in them, are organized according to the Construction Specifications Institute's (CSI) Masterformat system.
Report Holder—The name and address of the company or organization that has applied for the Evaluation Report.
Evaluation Subject—The specific product(s) covered by the report.
Evaluation Scope—The code(s) that were used to evaluate the product.
Properties Evaluated—A brief description of the properties the product was evaluated against such as fire resistance and wind resistance. This section also shows if the product can be used for structural purposes.
Uses—Identifies the scope of the Evaluation Report and relates the product evaluated to code provisions.
Description—Provides a general description of the product and its features, such as length, thickness, etc.
Installation—Identifies general and often specific requirements to help the inspector ensure the product is installed properly according to the code requirements or acceptance criteria.
Conditions of Use—Statement that the product, as described in the Evaluation Report, complies with or is a suitable alternative to the requirements of the applicable code and a list of conditions under which the report is issued.
Evidence Submitted—Data (i.e. test reports, calculations, installation instructions) that was used in evaluating the product.
Identification—Information that can be used to identify the product, including the manufacturer's name, product code, Evaluation Report number, etc.

From Design and Durability-South Coast Air District OKs Plan for VOC Limits on Coatings Colorants

The South Coast Air Quality Management District (SCAQMD) last week enacted the nation's first VOC regulation on colorants for architectural and industrial maintenance coatings.

In approving a number of amendments to the district's Rule 1113 on architectural and industrial maintenance coatings, the district also enacted lower VOC content limits on a number of specialty coatings. Also approved was the elimination of the rule's VOC "averaging" provision, which gives coatings manufacturing companies a flexibility option in meeting the rule's stringent VOC-content provisions. The averaging provision will be eliminated on Jan. 1, 2015.
