LA Condo Sues for Alleged Multiple Construction Defects-Decks Listed as a Leak Issue

Luxury Los Angeles Condominium Building Represented by The Miller Law Firm Files Suit for Faulty Construction in Excess of $3 Million
LOS ANGELES, Sept. 20, 2011 /PRNewswire/ -- The owners association for the 36-unit condominium building, located at 4568 West 1st Street in Los Angeles, filed suit today inLos Angeles Superior Court for damages in excess of $3 million related to shoddy workmanship and construction defects. Developed by an LLC formed by Astani Construction of Beverly Hills, the units were marketed as part of a luxury development that was sold in 2003.
Saddled with structural defects, excessive water intrusion, roof and window leaks and ensuing mold inside units, deck failures, and exterior walkway life-safety issues, the board at the Villa Del Capri- 101 S. Manhattan Place Homeowners Association gave notice to the builder six months before filing a lawsuit in the hopes of finding a resolution. The builder was unable to address all of the necessary and serious repairs and, now, the lawsuit includes claims for negligence, strict products liability and breach of contract.
According to the association's attorney, Thomas E. Miller, whose firm, The Miller Law Firm, has recovered over $550 million for construction defect claims, "More builders today are setting up their developer entity as a Limited Liability Company (LLC). Oftentimes, home and condo owners don't realize that insurance does exist to cover construction defects even after the builder sells, declares bankruptcy, or just walks away from the LLC it set up to build and sell the units."
EJ Kim, President of the Homeowners Association, states, "We are simply looking for enough funds to fix the problems and reinforce our homeowners' investments in this building. Our homeowners were stunned to discover hidden defects after relying on the builder's representations of a luxury mid-city lifestyle."
According to Karen Kokowicz of CORO Community Management & Consulting, "We contacted independent experts immediately upon receiving complaints of water intrusion and overall building deterioration. Addressing these issues timely was our main priority."

Las Vegas man pleads guilty in HOA fraud scheme

A Las Vegas man pleaded guilty today in connection with a scheme to fraudulently gain control of Southern Nevada condominium homeowners' associations so they could direct business to a certain law firm and construction company, the Justice Department announced today.
Darryl Scott Nichols, 47, pleaded guilty before U.S. District Judge Philip Pro in Las Vegas to one count of conspiracy to commit mail and wire fraud. The announcement was made by Assistant Attorney General Lanny Breuer of the Justice Department's Criminal Division, Special Agent in Charge Kevin Favreau of the FBI's Las Vegas Field Office and Metro Police Sheriff Doug Gillespie.
