Faulty decks , weatherproofing, doors, stucco and roof lead to 1.5 Million Settlement


Saw this press release from the Miller Law firm on a condo in San Francisco that recovered money for faulty construction...

/PRNewswire/ -- A contemporary condominium building at 1970 Sutter Street has recouped $1.5 million for numerous construction defects after only 9 months from hiring The Miller Law Firm.

The 19-unit residential building is located in the neighborhood where lower Pacific Heights and Western Addition converge.  The settlement was reached in mediation and is being funded by insurance companies for the builder, 1960 Sutter, LLC, the general contractor, Nibbi Brothers Construction, and window manufacturer Milguard Manufacturing, Inc. Failure of weatherproofing systems on the stucco siding, roof, windows, decks and doors, with water intrusion into the interior walls, floors and ceilings plagued this building. Damages of $78,000 per unit were recovered.

According to Thomas E. Miller, CEO of The Miller Law Firm, "This Association came to us after having been in litigation for nearly three years with no trial date and no resolution in sight.   Consumers should know that construction defect claims are a highly complex area of the law and the expertise needed to obtain a timely recovery is key."

Jeff Ho, President of the 1970 Sutter Street Owner's Association, states, "Getting a second opinion on the progress of our case was key to helping us determine that a viable alternative did exist to return a favorable recovery in a reasonable amount of time."

According to Karen Katz of Property Management One, "The serious defects and frequent repairs that this building faced were overwhelming.  Having this claim resolved with a recovery that will let them rebuild is important to the owners and to the community."

A durable, one coat, low-odor deck coating solution is now a reality for light pedestrian traffic areas such as balconies, roof terraces and mechanical rooms. The culmination of a two-year R&D initiative, Tremco's Vulkem OC810 Coating is a high-solids, aliphatic urethane membrane designed to be applied in one 35-40 mil coat for aesthetically pleasing, durable waterproofing protection that is mildew- and fungus-resistant and low VOC (less than 30g/L). 

Unlike traditional base and top coat applications that can take several days to apply, the appropriate Tremco primer and innovative Vulkem OC810 coating can be applied within the same day, allowing contractors and building owners to shorten construction timelines, realize labor cost savings and minimize the impact on occupants of inhabited spaces. The aging Mariner’s Inn was showing it’s wrinkles. Sold off to a new investor, the motel underwent a quick redo for the summer season while plans are drawn for a new hotel to be built in a few years.

In the meantime, the main attraction, the second story view deck needed major repairs. The ocean views are great, whales spouting off the coast were keeping us enteertained while we worked, otters and pelicans, gulls and terns are in abundance!

The job started with a tear off by the general contractor of the old decking, down to framing. Repairs to the framing and sloping installed via rip strips and new plywood solved that problem.

We then flashed the deck edges, then we installed Desert Crete decking over the lath as it was put down to isolate it from any salt air.

West Coast Waterproofing Services Dissolves, Reopens as West Coast Deck Waterproofing

With no fanfare, West Coast Waterproofing Services of Paramount dissolved their previous corporation as MasFran, Inc and 
has now become ROSCAT, Inc, dba West Coast Synthetic Deck Waterproofing  Services.

License information available at CSLB's website shows the new companies license was issued as of May 31st this year. 

Two previous licenses issued to the same entity have expired
